Terms & Conditions
These Terms & Conditions (“Terms”) govern your use of the Peer Messenger application and related services (collectively, the “Service”) operated by Peer Messenger (“we,” “us,” or “our”). By creating an account or using the Service, you agree to these Terms.
1. The Service
Peer Messenger is a decentralized social application. Your content is stored on your device and shared with contacts you approve. Our servers provide authentication, relay routing, and related infrastructure — not a hosted social feed or cloud photo library.
2. Eligibility
You must be at least 13 years old (or the minimum age required in your country) and able to form a binding contract. You must provide a valid mobile phone number you control for verification.
3. Your account
- You are responsible for activity on your account and for keeping your device secure.
- You must provide accurate information and keep it current.
- Do not share verification codes or authentication tokens with others.
- Notify us promptly at support@peermessage.net if you suspect unauthorized access.
4. Acceptable use
You agree not to:
- Use the Service for unlawful, harassing, abusive, or fraudulent purposes
- Upload or share content that infringes others’ rights or violates applicable law
- Attempt to probe, scan, or compromise our systems or other users’ devices
- Reverse engineer or interfere with the Service except where permitted by law
- Send spam, bulk unsolicited messages, or automated traffic through the Service
5. Your content
You retain ownership of content you create. You grant us and your chosen contacts the limited rights needed to operate the Service — for example, to relay encrypted content you choose to share. You represent that you have the rights to share content you publish through the Service.
6. Privacy
Our Privacy Policy describes how we handle personal information. By using the Service, you also agree to the Privacy Policy.
7. SMS verification (toll-free)
Peer Messenger may send one-time verification codes by SMS from our toll-free number when you request sign-in. This is a transactional program — not marketing.
- Consent: You opt in by entering your mobile number and checking the consent box in the Peer Messenger app (or equivalent control on our opt-in page) before requesting a code.
- Frequency: Codes are sent only when you request them, up to 3 messages per hour per phone number.
- Charges: Message and data rates may apply.
- Sample message: “[code] is your Peer Messenger verification code. It expires in a few minutes.”
- Help: Contact support@peermessage.net.
- Opt-out: Do not request a verification code if you do not wish to receive SMS. We do not operate a separate marketing SMS list.
See our SMS Opt-In Policy for full program details.
8. Third-party services
The Service may rely on third parties (e.g., SMS providers, push notification services, device operating systems). Their terms and policies may apply to those components.
9. Disclaimers
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. We do not guarantee uninterrupted or error-free operation.
10. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF DATA, PROFITS, OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICE IS LIMITED TO THE GREATER OF USD $100 OR THE AMOUNT YOU PAID US IN THE TWELVE MONTHS BEFORE THE CLAIM (TYPICALLY $0 FOR A FREE APP).
11. Termination
You may stop using the Service at any time. We may suspend or terminate access if you violate these Terms or if we discontinue the Service. Sections that by their nature should survive termination will survive.
12. Changes
We may modify these Terms. Material changes will be posted on this page with an updated effective date. Continued use after changes take effect constitutes acceptance.
13. Governing law
These Terms are governed by the laws of the State of Delaware, United States, without regard to conflict-of-law rules, except where mandatory local consumer protections apply.
